Just got this update... the 9th circuit just ruled that the CA recall has to be delayed because of outdated ballot machines... although the decision isn't being immediately implemented due to time alloted for a Supreme Court appeal...

I find it tooooo hilarious that they used Bush v Gore as a basis for this case!!!!!!!!

I swear, it's like a circus! The 9th district court was certainly busy this morning, ruling on elections. Right after delaying the CA recall, it also ruled that my state's blanket primary is unconstitutional. :mad:

I talked about this with my News Director today - word is it'll get overturned by the end of the week. I think Bush v. Gore was awful in that the taint of politics hit the Supreme Court - a place we as a nation rely upon to be apolitical. The dissent in Bush v. Gore made the same point.

The 9th may have a point in that it will take longer for poorer districts to get their act together by 10/7. Everyone deserves "equal protection" under the law.

BTW, if you think this 9th Circuit ruling was a coup by the LEFT WING, and not a legitimate case - think on this:
The longer this recall race goes on, the more media oxygen will be sucked up by it - leaving nothing for the DEM candidates running against Bush - and why would ANY party want to take control of California now and face the wrath of this state when it stops giggling in its drunkeness, and wakes up with a hangover?

If I was a hardcore left wing partisan, I'd vote for Arnold to win, just to make the Republicans look bad.

But regardless of the candidates - this recall is a BAD thing. I may not be a big fan of Davis (more his personality than his job performance), but democracy is at stake here.

This ruling is not surprising in the least bit. The Leftist 9th Circuit Court is the most overturned court in the nation and this is just another example of why. This is not the first time that they have done this, nor will it be the last.

I think the Supreme Court will overturn the recall decision, too. Although I agree with the 9th's ruling. Those counties had to comply by March anyway, to get rid of the outdated machines. The "will of the 'people'" for a recall will still stand next spring, too.

However, when was Court ever "apolitical"? In theory, it should be. But the Justices are appointed by partisan Presidents and approved by partisan Congresses. It's not a recent phenomenon for a political maelstrom to occur every time one of them retires.

They might be the most overturned court in the nation because they have the most cases. They have almost 10 times the number of cases the other courts have:
